Declaration of Martian Sovereignty

With Affirmation of Dual Earth–Mars Citizenship
Proclaimed in the Year of Our Common Era 2026 · MLA Registry Document No. 001

When in the course of human expansion it becomes necessary for a people to extend the bonds of civilization beyond the cradle of their birth — to reach across the void and plant the seeds of ordered society upon new and alien soil — a decent respect for the opinions of humanity requires that they declare the causes which impel them to this extraordinary undertaking.

We hold these truths to be self-evident: that all persons are endowed with the natural right to seek out new frontiers; that the exploration and settlement of the cosmos is the birthright of all humanity, not the exclusive province of any government or nation; that where willing persons invest their labor, their resources, and their vision to build civilization upon unclaimed ground, the right to govern that civilization inheres in those persons; and that no treaty written in the age of early satellites can adequately anticipate, much less extinguish, the sovereign aspirations of those who will actually live upon the surface of another world.

The Mars Land Authority, constituted by the voluntary compact of its registered citizens — drawn from every nation on Earth, united by a common aspiration — hereby issues this Declaration of Martian Sovereignty: not as an act of rebellion against any Earth government, but as an act of creation — the founding of a new and parallel civic identity for those bold enough to claim it.

Part I — Justification for Sovereign Declaration

The existing framework of international space law, admirable in its origins, fails to address the realities of private civilian settlement. The following truths compel this Declaration:

I.
The Legal Vacuum
The Outer Space Treaty of 1967, while prohibiting national appropriation by sovereign states, is silent upon the rights of private individuals and voluntary associations to establish civil governance and territorial registries upon celestial bodies. No international instrument has since filled this gap. In the absence of law, the natural rights of settlers prevail.
II.
The Precedent of Frontier Settlement
Throughout human history, organized communities formed ahead of formal governance have established legitimate civic authority through compact and consent. The Mayflower Compact, the constitutions of frontier territories, and the charters of trading companies all demonstrate that voluntary association preceded and legitimized formal statehood. The Mars Land Authority follows this ancient and honorable tradition.
III.
The Imminence of Physical Settlement
SpaceX has publicly committed to landing spacecraft on Mars as early as 2027, with human missions to follow. The governments of the United States, China, and the European Union maintain active Mars programs. The moment of first permanent settlement is not hypothetical — it is a scheduled event. Governance frameworks that do not exist at the moment of arrival will be constructed hastily, under pressure, and without the voice of those who came first. This Declaration ensures that voice exists before that moment arrives.
IV.
The Principle of Consent
No person shall be governed on Mars without their consent. Every citizen of the Mars Land Authority has voluntarily entered into this compact. No Earth government, having made no investment in Martian settlement and having no physical presence on Mars, may claim authority over those who built and inhabit it — except as expressly agreed by those citizens through their own governance mechanisms.
V.
The Preservation of Earth Bonds
This Declaration is not a severance from Earth. Martian citizens retain in full all rights, privileges, and responsibilities of their Earth citizenship. Mars sovereignty is additive — a second civic identity layered upon the first — not a replacement. The Mars Land Authority affirms, celebrates, and protects the dual citizenship of all its members.
Part II — The Doctrine of Dual Earth–Mars Citizenship

A central and distinguishing principle of Martian sovereignty under this Declaration is that Martian citizenship does not require, demand, or effect the relinquishment of any Earth citizenship. Every registered citizen of the Mars Land Authority simultaneously holds:

Article of Dual Citizenship — Binding Doctrine

Earth Citizenship (Retained in Full): Each citizen retains complete legal status, rights, protections, and obligations under the laws of their respective nation of Earth citizenship — be it the United States of America, the United Kingdom, the Federal Republic of Germany, the Republic of India, the People's Republic of China, or any other sovereign Earth nation. No act of Mars Land Authority registration shall be interpreted, in any jurisdiction, as constituting renunciation of Earth citizenship.

Martian Citizenship (Newly Acquired): Each registered citizen simultaneously acquires a Martian civic identity — recorded in the MLA Astral Territorial Registry, assigned a permanent ADIM number, and accorded all rights enumerated in the Martian Bill of Rights. This citizenship is recognized by all members of the MLA compact and shall be advanced before all international bodies as a legitimate and lawful exercise of private civil organization.

Children Born of Martian Citizens: Any child born to one or more registered MLA citizens acquires Martian citizenship by descent from the moment of birth, without prejudice to any Earth citizenship they may hold by birth, descent, or naturalization under the laws of any Earth nation. Such children shall receive a Martian Birth Certificate documenting both their Earth nativity and their Martian civic inheritance.

Conflict of Laws: In any matter of conflict between Martian civic governance and the laws of an Earth nation, citizens shall be guided by the principle that Mars governance applies to matters of Martian territory and affairs, and Earth law applies to matters of Earth territory and affairs. Where jurisdiction is unclear, the citizen's own consent and the principle of harm prevention shall govern.

Part III — Establishment of Martian Civil Governance

We, the registered citizens of the Mars Land Authority, do hereby establish and ordain the following foundational structures of Martian civil governance, to be elaborated and amended by the will of the citizen body as our community grows:

I.
The Astral Territorial Registry
The MLA Registry shall serve as the founding ledger of Martian civilization — recording all territorial claims, all citizen identities (by ADIM number), all transfers of land, and all acts of civic governance. The Registry shall be maintained in perpetuity, encrypted against loss, and made open to public inspection by any citizen.
II.
The Council of Founders
A Council of Founders, composed of all Founder-tier citizens, shall serve as the deliberative body of the MLA until such time as a formal elected legislature can be constituted. The Council shall advise on governance, represent citizen interests before international bodies, and ratify any amendments to this Declaration.
III.
The Mars Infrastructure Fund
A dedicated capital reserve — the Mars Infrastructure Fund — shall be maintained from proceeds of territorial registrations. Its purpose is the eventual physical establishment of MLA presence on Mars through contracted robotic services, cargo manifest placements, and physical territorial markers. The Fund shall be administered transparently, with annual accounting provided to all citizens.
IV.
Universal Suffrage and Civic Equality
All registered MLA citizens, regardless of the size of their territorial holdings, their Earth nationality, their gender, their race, their religion, or any other characteristic, are equal in their civic standing. One citizen, one voice. All governance decisions shall ultimately derive their legitimacy from the consent of the citizen body.
V.
Future Constitutional Convention
This Declaration is a founding document, not a final constitution. When the citizen body reaches ten thousand registered members, the Council of Founders shall convene a Constitutional Convention open to all citizens, at which a formal Constitution of Mars — incorporating this Declaration, the Martian Bill of Rights, and such additional provisions as the citizen body shall determine — shall be drafted, debated, and ratified.
We therefore, the registered citizens of the Mars Land Authority,
assembled in voluntary compact across all nations of Earth,
appealing to the natural rights of humanity and to the judgment of history,
do solemnly publish and declare:

That the Mars Land Authority is, and of right ought to be,
a free and sovereign civil community;
that its citizens hold their Martian citizenship equally with their Earth citizenship;
that its territorial registry represents a lawful and legitimate exercise
of private civil organization under the laws of nature and of nations;
and that we mutually pledge to this Declaration and to one another
our commitment, our resources, and our sacred honor.
